mußte noch hinzugefügt werden, weil eben nach der Ansicht der frühem Stände bei den Gesetzen über ganz geringfügige Rechts sachen man doch einigen Spielraum den Parteien lassen wollte, zu erscheinen, damit Jemand nicht blos wegen Verschiedenheit der Uhren in Rechtsnachtheil versetzt werde, und es wurde daher der Satz mit ausgenommen, es solle der peremtorische Aufruf mit der Wirkung der Contumaz nur erst nach Ablauf einer Stunde von der in der Vorladung festgesetzten an gerechnet ein treten können.' ' Hat die jenseitige Kammer diesem Anträge nicht beigestimmt, ist sie vielmehr auf den Gesetzentwurf zurück gegangen, so muß das Ministerium wünschen, daß die erste Kammer auch auf den Gesetzentwurf zurückgeht. Es kommt in der That nur darauf an, einen Zweifel zu lösen, nicht aber etwas Neues zu bestimmen. Es hat der Referent zur Unter stützung der früher» Ansicht zwar einige Gründe angeführt, die jedoch nicht genügen dürften. Er sagt, es müsse einmal eine bestimmte Zeit festgesetzt werden, und da möchte sie lieber gleich nach Ablauf der Stunde eintreten. Nun wird aber der Refe rent gewiß damit einverstanden sein, daß die Contumaz nur ein nothwendiges Uebel ist, nur formelles Recht gewährt, und daß es daher an und für sich schon ein Uebelstand ist, Jemandem sein Recht blos deshalb abzusprechen, weil er zur bestimmten Zeit nicht erschienen ist. Offenbar ist es aber doppelt hart, wenn man gleich innerhalb einer Stunde contumaciren will; denn wenn der Richter wegen anderer Verhandlungen nicht im Stande ist, die Parteien gleich nach Ablauf der Stunde vorzu lassen, so sieht man nicht ein, warum die Partei früher erschei nen und wegen des Nichterscheinens, das Niemandem Eintrag thut, seines Rechtes verlustig werden soll. Es würde aller dings dieser Vorschlag der ersten Kammer sehr hart für t ie Par teien sein und über den Zweck der Contumaz hinausgehen. Es bcm-'rkte der Referent ferner, wenn Jemand unverschuldet zu spät käme, er Wiedereinsetzung in den vorigen Stand haben soll. Was ist dies aber für ein weitläufiger W?g. Was setzt die Wieverrinsetzung für Erörterungen und Bescheinigungen voraus. Wiwi.l wird nun erst hierüber unter den Parteien gestritten werden. Ja die von ihm bemerkten Fälle möchten schwerlich alle zur Wiedereinsetzung sich e'gnen. Und weshalb alle diese Weitläufigkeiten? weil die Partei vielleicht 5 Minu ten nach dem Schlage der Uhr gekommen ist, aber früher noch, als sie vorgelaffen werden konnte. Wenn g'gen den Vorschlag der D pulation der zweiten Kammer bemerkt worden ist, daß der richterlichen Willkühr zu viel Spielraum gegeben werde, so läßt sich eine solche richterliche Willkühr sehr leicht durch eine Vorschrift beseitigen. Man braucht nur den Gerichten vorzu schreiben, sie sollen die Reihefolgr, in welcher sie die einzelnen Sachen zur Verhandlung vornehmen wollen, im Voraus durch Anschlag bekannt machen. Dies sind die Gründe, warum ich wünsche, daß die erste Kammer die frühere Ansicht aufgebe. Referent 0. Schilling: Gegen die Bemerkung Sr.Ex- cellenz, daß die Deputation etwas ganz Neues beantragt habe, muß ich erinnern, daß bei allen Gerichten das schon bereits angenommen worden ist. So weiß ich, daß es bei dem Stadt gerichte zu Dresden angenommen worden ist, daß, wenn die Partei nicht zur bestimmten Stunde erschienen ist, sie als dann für ausgeblieben erachtet wird. Also etwas ganz Neues ist es nicht; allein bisher vor dem Gesetze von 1839 konnten auch in geringfügigen Sachen sich die Parteien durch ihren An walt anmelden, da brauchte Einer auf den Andern nicht zu warten, sondern sie entfernten sich vom Gerichte. Es war auch nicht nöthig, daß der Richter gleich entschied, sondern erkannte es eben so gut verschieben, das fällt gänzlich weg. Sodann wurde von Sr. Excellenz bemerkt, es sei für den Richter be schwerlich, wenn die Stunde ausgeschlagen habe, die auf die in der Vorladung bestimmte zunächst folgt, so werde er, um den Aufruf vorzunehmen, in seinen Geschäften unterbrochen werden. Allein diesen Aufruf braucht der Richter nicht in eigner Person vorzunehmen, und so glaube ich, hat es. sich auch in praxi gestaltet; er läßt durch den Gerichtsboten die Namen der vorgeladenen Parteien verlesen, und nun Muß sich durch eine bejahende Antwort oder durch Stillschweigen er geben, ob die Parteien da sind oder nicht. Daß ferner die cuuluiuacis ein Uebelstand sei, kann ich eben so wenig, als die übrigen Mitglieder der Deputation anerkennen, aber es ist ein nothwendiges Uebel, wir können es nicht aus dem Pro teste Hinwegbringen, ohne nicht die Ordnung zu entfernen, auch klingt es in dec That härter als es ist, es ist nur von einer Stunde die Rede, die zunächst noch zugegeben wird nächst der, die in der Vorladung bestimmt ist. Dos wäre hart, wenn Je mand gleich nach einer Minute nach Ablauf der zur Vorladung bestimmten Stunde für versäumt am Termine erachtet werden soll; er hat aber noch eine ganze Stunde Zeit. Wenn Je mandem unterwegs ein Wagenrad bricht, so kann der Fall eben so gut eintreten, wenn die Versäumniß am Termine um 12 Uhr oder um 5 Uhr stattfindet; denn es fahrt dann einer nicht früh-.r aus, als daß er ungefähr um 12 Uhr da sein kann. Nun bitte ich aber noch, meine Herren, zu bedenken, in welche Verlegenheit der Richter kommt, wenn 10 Parteien alle zu derselben Stunde abgeserkigt sein wollen. Welche soll der Richter expediren? Es sind vielleicht Eide zu leisten, und es ist nicht anders möglich, als daß er entweder die Parteien fort schicken und zu einem andern Tage wieder bestellen muß, was eine Belästigung für die Parteien ist, oder er muß die Sache oberflächlich ablhun. Wie beschwerlich ist das nicht für eine Partei, die pünkrlich erschienen ist, aber mehre Stunden war ten soll, wodurch die andere sie vielleicht chicaniren will, indem sie dieselbe mehre Stunden warten läßt. Kurz, weyn man das von den verschiedenen Seiten, die hierbei in Betracht zu zieh n sind, erwägt, so scheint es doch fast unerläßlich, diese Bestimmung, wenn Ordnung in das Verfahren bei Rechts streiligkeiten kommen soll, anzunehmen, und die Deputation muß den Vorschlag wiederholen, daß die Kammer bei ihrem frühem Beschlüsse stehen bleibe; jedoch will ich hinzufügen, daß, wenn die zweite Kammer nicht unserm Beschlüsse bei treten sollte, ich und wahrscheinlich auch die andern Mitglieder der Deputation es für zweckmäßig halte, daß wir lieber den
