als wie in dem ursprünglich angenommenen einzelnen Tracte. Dieser Fall kann vorkommen und cs wird daher -empfehlenswert!) sein, wenn man vielleicht bei künftigen Negulirungcn die ins Auge zu fassenden Rcgulirungs- tracte nicht zu klein nimmt; gerade hierin liegt die größte Gefahr für Negulirungen, die an und für sich Wünschens werth sein können. Ich halte cs für besser, die Genossen schaften werden größer gemacht und die zu regulircnden Tracte in längerer Ausdehnung ins Auge gefaßt, als zcit- her der Fall war. Dadurchwerden möglicherweise diejenigen Majoritäten geschaffen, welche für eine an sich nützliche Regulirung eines Flusses erforderlich sind. Ich habe diese wenigen Worte mir erlaubt, um, wie ich bereits im Ein gänge sagte, im Auftrage des abwesenden Herrn Abg. Schade die Petenten zu vertreten. Ich werde mich auf Weiteres nicht einlassen, indem ich gemeint bin, demDepu- tationsgulachtcn meine Zustimmung zu geben, und indem ich die Hoffnung habe, daß Das, was von mir angedcutet worden ist, nicht unbeachtet an dem Ohre der Staatsregic- rung vorübcrgegangen sein wird. Referent Otto: In der Hauptsache hat sich der Herr Vicepräsident mit dem Berichte der Deputation einverstan den erklärt und nur an den Worten Anstoß gefunden, daß es fast nicht möglich sein werde, mit bestimmten Anträgen vorzutreten. Das, meine Herren, war für die Deputation eine sehr schwere Aufgabe; selbst der Abg. Schade, der in der Deputation bei der Berathung. des vorliegenden Ge genstandes zugezogcn wurde, konnte im Augenblicke dar über keine Auskunft, geben und bestimmte Anträge stellen. Deshalb hielt cs auch die Deputation für besser, nicht mit bestimmten Anträgen vor die Kammer zu treten, sondern dies der.Staatsrcgierung zu überlassen. Meine Herren! Ich selbst bin Uferbewohner, mit den Verhältnissen der Hochfluthcn genau bekannt; allein ob gerade Das, was der Herr Vicepräsident aufstellte und was vom Abg. Schade angegeben worden, das Richtige ist, möchte ich da hingestellt sein lassen. Ich glaube, wir können es ruhig der Staatsrcgicrung anhcimgeben, sre wird die Sache erörtern und gewiß die Mittel und Wege finden, durch welche sich die Uebelstände beseitigen lassen. Ich hoffe, der Majoritäts beschluß wird nicht nothwcndig werden, wenn Das befolgt wird, was im Berichte gesagt ist, daß Commission und Sach verständige mit den Bctheiligtcn in gegenseitiges Vernehmen treten. Geschieht dies, wird ein Segen fürs Vaterland und die Landwirtschaft nicht ausbleiben. DerHerrVicepräsident sprach noch davon, daß nicht kleine Bezirke gebildet werden mochten, sondern größere. Das widerspricht gänzlich der Petition, die wir gestern bekommen haben. Die Petenten wünschen eine Abänderung des Gesetzes vorzüglich des halb, damit kleine Bezirke gebildet werden möchten; denn sie sagen: wenn das Gesetz abgcändcrt wird, dann könnte -es der Stadt Leipzig nicht möglich sein, auf die Neguli- rung einer größeren Strecke anzutragen, sondern sie müßte - die Ausführung allein übernehmen. Vicepräsident Oeh mich en: Nur zur Berichtigung einer Thatsache bitte ich ums Wort! In der Petition, welche soeben der Herr Referent erwähnt hat, habe ich davon Nichts gefunden; die Petenten beantragen nicht sowohl kleine Bezirke, sondern sie meinen nur, der Tract l bei der Elsterrcgulirung würde allein von der Stadt Leipzig herzustcllcn sein, weil die Stadt Leipzig wesentlichen Vor- theil davon gehabt hätte. Abg. Mosch: Da dcrfHerr Vicepräsident erklärt hat,, daß er im Allgemeinen mit dem Deputationsbcrichte ein verstanden sei und sich dem Schlußantragc anschließen wolle, liegt eigentlich für die Deputationsmitglieder keine Veranlassung vor, auf seine Rede Etwas zu erwidern. Ich habe mir nur das Wort erbeten, um einer falschen Auf fassung zu begegnen, die sich darin zu zeigen scheint, daß von einem Widerspruche gesprochen wird, der auf Seite 368 des Berichts mit dem Schlußäntrage zu finden sei. Auf Seite 268 ist nämlich gesagt, es erhelle, daß kaum ein Gesetz zu schaffen sei, welches allen Verhältnissen Rechnung trage. Dieser Satz widerspricht aber keines wegs dem Schlußantragc; im Gegcnthcile, die Deputation erkennt vollständig an, daß ein Ausweg, wie ein Majori tätsbeschluß noch hcrzustellen sei, sich wohl noch ausfindig machen lasse; wohl aber ist sie darüber im Klaren, daß all en Interessenten kaum jemals Rechnung getragen wird; denn einer Majorität steht jedesmal eine Minorität gegen über und diese Minorität wird sich stets, wenn die Ma jorität anderer Ansicht ist, für benachtheiligt halten. Ich sollte also meinen, daß ein Widerspruch im Deputations berichte keineswegs zu finden ist. Präsident Haberkorn: Begehrt noch Jemand das Wort? — Der Herr Staatsminister! Staatsminister vvnNostitz-Wallwitz: Wie aus dem vorliegenden Berichte hcrvorgcht, nimmt die Staats regierung dem vorliegenden Hauptantrage gegenüber durch aus keine unbedingt ablehnende Haltung ein. Ich selbst halte Manches, was von dem Herrn Vicepräsidcnten aus geführt worden ist, für begründet und kann mich der Ucberzeugung nicht ganz entschlagen, daß mit dem Ver fahren, wie es das Gesetz jetzt vorschreibt, auf die Dauer nicht fortzukvmmen sein wird. Ich würde, wenn es mög lich ist, einen Ausweg zu finden, wie er von den Petenten beantragt wird, dies für'sehr erwünscht halten, einmal, um den Interessen der Bethciligten eine formale Garantie zu verschaffen; zum Anderen aber auch, um die Verwal tung von Hemmnissen und Beschwerden zu befreien, unter denen — ich sage cs offen — schlüßlich der fleißigste und gewissenhafteste Beamte ermatten muß.
