einer besonderen Steuer belegt werden, die zwischen der für 1 Acker Feld und 1 Acker Wiese die Mitte halt und sich in dem Maße verdop pelt, verdreifacht, vervierfacht u. s. w., je nachdem das Arealzube- hör des Gehöftes 24 oder 48 oder 72 Acker u. s. w. übersteigt. Wenn man mithin auch dort Bedenken getragen hat, die Besteuerung länd licher Gebäude auf eine einzelne Abschätzung derselben zu begründen, so dürfte sich auch damit dieses Separatvotum rechtfertigen, dessen Tendenz schlüßlich dahin gehet: 1) daß alle landwirthschaftliche Ge bäude auf hem Lande, deren Zubehör an Feld, Wiese und Holzbo den ein Steuercapital von 2000 Thlr. und darüber erreicht, nur nach Maßgabe dieses letzteren in der Art besteuert werden, daß diese Gebäudesteucr stets den lOten Theil jener Grundsteuer beträgt; 2) daß bei allem übrigen Grundbesitz, dessen Complex ein Steuerca pital von 2000 Thlr. nicht erreicht, bloß das Wohnhaus nach seinem Gebrauchswerthe abgeschatzt und besteuert wird; die dazu gehörigen Scheunen und Nebengebäude aber sowohl von der Taxe, als auch von jeder weiteren Besteuerung liberirt bleiben, in sofern sie nicht zum Betriebe besonderer Gewerbe dienen. Die Deputation äußert aber gegen das Separatvotum: Die Mehrheit der Deputation halt sich überzeugt, daß die ländlichen Wirthschaftsgebaude, so wie dergleichen Wohnge bäude, selbstständig zu bewerthen. Diese Bewerthung möchte aber nicht durch Gewerken erfolgen. Es würde dieß letztere eines Lheils äußerst aufhältlich, andern Theils aber auch minder pas send sein, da diese nicht den gewöhnlichen Kaufwerth des Gebäu des, sondcrn imnicr mehr oder weniger den Kostenaufwand, den das von ihnen zu bewerthendc Gebäude bei seinem Zkufbau kosten würde, bei ihren Taxen vor Augen haben; auch dürften diesel ben minder geschickt sein, bei ihrer Taxation, neben der Beschaf fenheit der Gebäude hinsichtlich der Materialien und der Dauer haftigkeit, zugleich den hier allerdings mit in Anschlag zu brin genden Hauptumstand: die ökonomische Zweckmäßigkeit und Brauchbarkeit dieser Gebäude, genügend zu beurtheilen. — Die Gründe nun, welche gegen eine Proccntisirung sprechen und überwiegend geschienen, sind folgende: Es zeigt sich keine Noth- wend'gkeit, von dem oben im Allgemeinen aufgestellten Princip (§. l. des specicllm Theils des Gutachtens) abzugehen, wonach der mittlere Werlh jedes Westcuerungsgegenstandes als Maßstab der Besteuerung angenommen worden ist. Auch dergleichen Wirthschaftsgebaude haben off nbar ihren selbstständigen und eben so leicht, wie bei jedem a rdern Gebäude, zu ermittelnden Werth. Derselbe ist den Landbewohnern nicht fremd; es ist be kannt, daß nicht selten einzelne dergleichen Gebäude, insonder heit Scheunen, auf den Abbruch verkauft werden, und über hauptberechnet sich in der Regel jeder Käufer einer Landwirth- schaft, ehe er den Kauf darüber abschließt, eben so wohl den Werth der Felder, Wiesen rc., als der dabei befindlichen Wirth- schaftsgebäude, und zahlt, wie die Erfahrung tagtäglich lehrt, für ein mit guten Wirth schaftsgcbäuden versehenes Landgut mehr, als für ein solches, das zwar hinsichtlich der dazu gehöri gen Felder ,'w.d Wiesen von gleicher Größe, Güte und Beschaf fenheit ist, daneben aber schlechte Wirthschaftsgebäude hat. Je weniger daher überhaupt ein, aus der Natur der hier in Anwen dung zu bringenden Bewerthung selbst hervorgehender Grund vorhanden, um das, bei dem ganzen Besteuerungswerke anzu nehmende und durchaus als zureichend sich hervorthucnde Prin- cip bei einem einzelnen Gegenstände der Besteuerung hinwiede rum abzuändern und zu verlassen, und je weniger hierüber in sonderheit gegründete Veranlassung vorhanden, in die Befähi gung der Landbewohner: dergleichen Wirthschaftsgebäude, die sie selbst besitzen und erbauen lassen, zu bewerthen, Zweifel zu setzen, um so mehr mußte sich die Majorität der Deputation be wogen fühlen, wie gedacht, der zuerst gefaßten Ansicht zu entsa gen. Dazu kamen aber noch andere der Letzteren entgegenste hende , nicht unwichtige Bedenken. Diese sind das Beschwer liche und Unsichere der Bewerthung, wenn das Gebäude Wirth schaftsgebäude und Wohngebäude zugleich ist; weiter, die dann nothwcndige, aber zu großer Ungleichheit im Verhältniß zu an dern Städten und zu bedeutender Beschwerung anderer Steuer pflichtigen führende Gleichstellung der ackerbauenden Städte mit den Dörfern und die dann eintretende, nicht zu bevor- wortende Begünstigung des Begüterten auf dem Lande zum Nachtheile des -Hauslers, mcht zu verschweigen, daß selbst-Scheunen, besonders in der Nahe der Städte, nicht zur Wirthschaft, sondern zu Niederlagen benutzt wer den. Die ackerbauendem Städte und die einzelnen Bürger n solchen würden von ihren Gebäuden, bei welchen gewöhnlich >ie zuerst erwähnte Combinirung der Zwecke, des Wohnens und der Wirthschaft, statt findet, bald zu wenig, bald zu viel zu den Steuern beitragen, je nachdem die Gebäude des Einen oder des Andern mehr oder minder als Wirthschafts- oder Wohngebäude bei der Taxation betrachtet würden, und ein Häusler würde nicht selten von seinem mäßigen Hause mehr beizusteurrn haben, als ein Begüterter, der ein weit größeres Haus, als jener, be sitzt, sobald er dasselbe, sei es nun aus Bedurfniß oder aus Spe kulation, mit zu landwirthschastlicher Benutzung eimichteh und so würden große Gebäude eines Begüterten bei einem geringen Grundbesitz an Feldern, Wiesen und dergleichen sehr oft ein klei neres Steuercapital bilden, als das kleinste Haus eines Häus lers. Im Gegentheile aber würde auch wieder bei einem sehr großen Grundbesitze von z. B. 200,000 bis 300,000 Thlr. das Steuercapital der Gebäude zu 20,000 bis 30,000 Thlr. auf wachsen, und solchenfalls für den Besitzer zu hoch ausfallen. Es würde also sehr oft ein großes Mißverhältnkß zwischen den einzelnen Städten, zwischen den Grundeigenthümern jeder ein zelnen Stadt und in jedem einzelnen Dorfe, so wie zwischen den einzelnen Rittergutsbesitzern hcrvortreten, und dieß zu lauten und nicht unbegründeten Klagen führen, welche, da eine Wewer- thung der Alder re., abgesehen von den zu ihrer Bewirthschaf- tung erforderlichen Gebäuden, recht leicht geschehen kann, sehr wohl vermieden werden können, und daher auch nach der Mei nung, welche die Majorität der Deputation angenommen hat,. füglich zu vermeiden sind. Abg. Runde: Meine Herren, das Separatvotum sud tun», welches dem Dcputationsgutachten beigefügt ist, ward bei mir durch den Umstand hervvrgerufen, daß die Deputation damals noch von der Ansicht ausgkng, den Werth sämmtlicher Gebäude überhaupt, und also auch den der landwirthschaftlichen nach ihrem Kauf- und Bauwerth zu bestimmen. Mir schien diese Bestim mung mit so großen Schwierigkeiten und Widersprüchen ver knüpft zu sein, daß ich mich bemühte, eine andere Modalität auf zusuchen. Namentlich fand ich eine Schwierigkeit darin, daß der Landmann, welcher sein Gut gewöhnlich im Complexe kauft, da bei selten die Gebäude speciell ins Auge faßt, und abschätzt. Nur bei kleinen Häuölernahrungen tritt das Gebäude als ein Haupt object des Kaufwerthes hervor; bei derAcquisition emesBauern- gutes, welches gewöhnlich im Zusammenhänge gekauft wird, nimmt man an, daß die Gebäude eine nothwendige Bedingung und schon im Preise des Areals mit inbegriffen sind. In dem frühem Gutachten der Deputation ward aber verlangt, daß Leute dieser Art den Schätzungswerth ihrer Gehöfte angeben, und also über den Werth einer Sache ein genaues Urtheil abgeben sollen, von deren Werth sie keine richtige Vorstellung haben kön nen, weil sie im täglichen Leben und Verkehr, sich mit Abschätzun-
